How high may the deposit (Kaution) be?

The deposit may be no more than three months' net cold rent (§ 551 para. 1 BGB). Anything above that is unlawful and can be reclaimed immediately.

When must the deposit be returned?

After you move out, the landlord has a reasonable review period, generally up to six months. After that, the deposit plus interest must be paid out (established BGH case law).

Must the deposit earn interest?

Yes. The landlord must invest the deposit in an interest-bearing account; the interest belongs to the tenant (§ 551 para. 3 BGB).
