After a modernisation, the landlord may pass on 8% of the costs onto the annual rent — capped by a ceiling.

How much may be passed on after a modernisation?

The landlord may add 8% of the modernisation costs attributable to your flat to the annual rent (§ 559 para. 1 BGB).

Is there an upper limit?

Yes. Over six years the rent may rise by no more than €3/m², and by no more than €2/m² for rents below €7/m² (§ 559 para. 3a BGB).

Are saved repairs deducted?

Yes. The maintenance portion (saved repair costs) must be deducted before the 8% is applied (§ 559 para. 2 BGB).
