When does the Mietpreisbremse (rent cap) apply?
In areas with a strained housing market, the rent on a new lease may be at most 10% above the local comparable rent (ortsübliche Vergleichsmiete) (§ 556d BGB). The check compares your rent against the local Mietspiegel (rent index).
Which flats are exempt from the rent cap?
Exemptions apply to new-build properties first occupied after 1 October 2014, extensively modernised flats, and cases where the previous tenant already paid a higher rent (§ 556f BGB).
How do I reclaim overpaid rent?
You object to the excessive rent in writing to your landlord (§ 556g para. 2 BGB). From the moment the objection is received, you can reclaim amounts overpaid going forward. On request, the check generates a sample letter.
