Do I have a right to sublet?
If you have a legitimate interest that arose after the contract was concluded, you have a right to permission to sublet part of the flat (§ 553 para. 1 BGB).
May the landlord charge a surcharge?
Yes. The landlord may make permission conditional on a reasonable subletting surcharge if letting would otherwise be unreasonable for them (§ 553 para. 2 BGB).
