When is a floor-area discrepancy a defect?
If the actual living area is more than 10% smaller than the area agreed, a defect exists; the rent may be reduced by the full percentage of the discrepancy (BGH VIII ZR 266/14).
How is living area calculated?
Under the Living Area Ordinance (Wohnflächenverordnung): rooms of full height count 100%, areas under sloping ceilings (1–2 m) count 50%, below 1 m not at all, and balconies and terraces usually 25%.
