At what level of arrears does termination without notice threaten?
The landlord may terminate without notice once the arrears reach two months' rent (§ 543 para. 2 no. 3 BGB).
Can I still avert the termination?
Yes. Termination without notice becomes ineffective if the entire arrears are settled within two months of service of the eviction claim (grace-period payment, Schonfristzahlung, § 569 para. 3 no. 2 BGB) — at most once in two years.
Does the payment also cure an ordinary termination?
No. The grace-period payment only cures the termination without notice. An ordinary termination issued at the same time under § 573 BGB remains effective under previous BGH case law.
